Terms of Service

Last updated: January 15, 2025

1. Acceptance of Terms

By accessing or using Devfolium ("the Service"), operated at devfolium.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Devfolium is a developer portfolio platform that generates professional profile pages from your GitHub data. The Service includes profile generation, customizable widgets, analytics, custom domain support, and subscription-based premium features.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration

To use the Service, you must authenticate via GitHub OAuth. By doing so, you:

  • Confirm you are at least 13 years of age
  • Authorize us to access your public GitHub profile data
  • Accept responsibility for all activity under your account
  • Agree to maintain the security of your authentication credentials

You must not create accounts for the purpose of impersonating another person or misrepresenting your identity. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Distribute malware, spam, or harmful content
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Scrape, crawl, or harvest data from other users' profiles without consent
  • Use automated tools to create accounts or manipulate the Service
  • Post content that is defamatory, obscene, or promotes violence or discrimination
  • Interfere with or disrupt the integrity or performance of the Service

5. User Content

You retain all ownership rights to content you provide to the Service (custom bios, social links, profile configurations). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content solely in connection with operating and providing the Service.

GitHub data displayed on your profile (repositories, contributions, stats) remains subject to GitHub's terms of service. We display this data as authorized through the GitHub API.

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

6. Subscriptions and Payments

6.1 Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all orders. Paddle provides all customer service inquiries and handles returns related to payment processing.

6.2 Pricing and Taxes

Subscription prices are displayed on our pricing page. Prices are exclusive of applicable taxes, which may be added at checkout by Paddle based on your location. We reserve the right to change pricing with reasonable notice to existing subscribers.

6.3 Billing Cycle

Subscriptions are billed on a recurring basis (monthly or annually, depending on your chosen plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

6.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. No partial refunds are provided for unused time within a billing cycle.

7. Refunds

Refund requests are handled in accordance with our Refund Policy. Generally, we offer a 14-day refund window for new subscriptions. After this period, purchases are non-refundable except at our sole discretion.

8. Custom Domains

If you configure a custom domain for your profile, you are responsible for maintaining ownership and DNS configuration of that domain. We are not responsible for domain registration, renewal, or any disputes related to domain ownership.

9. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Devfolium and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

The Devfolium name, logo, and related marks are our trademarks. You may not use them without our permission.

10. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in conduct that we determine is harmful to the Service or other users.

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination (including limitations of liability, indemnification, and dispute resolution) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy or completeness of GitHub data displayed on profiles, as this data is sourced from third-party APIs.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVFOLIUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Any third-party conduct on the Service
  • Any other matter relating to the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Devfolium, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action or representative proceeding.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
